18/02/2008 – Brussels - Written statement of the Bulgarian Euro deputy Slavi Binev on the report of Gérard Onesta (A6-0027/2009) - Revision of the Rules on the process of submission and consideration of petitions
The Bulgarian Euro deputy Slavi Binev submitted written statement on the report of Gérard Onesta (A6-0027/2009) - Revision of the Rules on the process of submission and consideration of petitions. “I appeal to the carefully consideration of two problems in the process of considering the petitions in the Committee on Petitions. The first is related to the submission of the facts, and the second - is the lack of opportunity the defendant, except the importer, to face the Commission. In the petition № 0795/2007 the facts are porously represented only from one point of view; the defendant - the Bulgarian Orthodox Church (BOC) was not invited to submit its opinion. During the fact finding mission of the Commission to Bulgaria from 27-30 October 2008, had not sought the position of BOC. Thus the attempts to slander the Holy Orthodox Church in Bulgaria to take its right of self-government are supported by the improper of the petition of the "Alternative Synod" and this created conditions for misleading of the members of the Commission.
The authors of the petition are seeking the opportunity to decide the future of BOC not according the established fro centuries church canons, but through the intervention of a secular institution - the court in Strasbourg.
As a result of internal church divisions permitted in canonical order of the Church in 1998, The Court in Strasbourg made a decision on an internal for the church case, in which case the Bulgarian Orthodox Church is not even treated as defendant. The truth is that no secular court is permitted or authorized to consider religious disputes!” states the text submitted by Mr. Slavi Binev.
